11. Definitions

1.1. “Moto NZ”, “we”, “us”, or “our” refers to the vendor and legal entity supplying the goods. 1.2. “Purchaser”, “Customer”, or “you” refers to the individual or entity acquiring goods from Moto NZ pursuant to this agreement. 1.3. “Goods” refers to the vehicle(s) or product(s) sold by Moto NZ to the Purchaser.

2. Delivery

2.1. Delivery of Goods is available throughout New Zealand. 2.2. Delivery is estimated at approximately 50 days from the date of order confirmation. 2.3. All delivery timeframes are indicative only and shall not constitute a condition or term of the contract. 2.4. Delays in delivery, including but not limited to customs processing, international shipping, freight delays, or third-party handling, shall not entitle the Purchaser to cancel the order, seek compensation, or claim a refund. 2.5. The Purchaser shall ensure availability to receive the Goods. Moto NZ disclaims all liability for any storage, redelivery, or associated costs resulting from failed delivery attempts. 2.6. The Purchaser must inspect the Goods within 48 hours of delivery and notify Moto NZ in writing of any damage incurred during transit. Such notification must be accompanied by clear photographic evidence and any supporting documentation. 2.7. Moto NZ may provide order and shipping documentation to assist with freight or insurance claims, but all claims must be lodged by the Purchaser directly with the manufacturer or freight provider. 2.8. Moto NZ accepts no liability for damage, loss, or delay caused by third-party freight agents. 2.9. Claims made outside the 48-hour window may not be eligible for any assistance, support, or warranty consideration.

3. Warranty

3.1 Warranty All new motorcycles sold by Moto NZ include a manufacturer’s warranty covering the battery, motor, controller, charger, frame, and key structural components. Warranty length depends on the brand: 79 Bike, Arctic Leopard, and Champ – 12 months, Talaria – 24 months 3.2. Warranty coverage is conditional upon: Use and maintenance in accordance with the User Manual. No modifications, disassembly, or unauthorised repairs. Use of only original parts and accessories. No damage from misuse, impact, natural disasters, or riding outside intended conditions. 3.3. Warranty claims must be submitted to Moto NZ with dated proof of purchase. If the fault is confirmed as a manufacturing defect (not caused by the user), Moto NZ will arrange free repair or replacement. 3.4. The following components are covered for 12 months: 3.4.1. Battery, Abnormal voltage, failure to charge, or capacity below 75% (temperature-adjusted). 3.4.2. Motor, Coil failure, magnet demagnetisation, damaged bearings, etc. 3.4.3. Charger & Controller, Non-user-caused charging faults. 3.4.4. Main Wiring, Short circuits, broken connections (if unopened and intact). 3.4.5. Meter/Performance faults due to manufacturing defects. 3.4.6. Frame & Suspension, Cracks, weld failure, leakage, or deformation not caused by impact. 3.5. The following are excluded from warranty: 3.5.1. Wear & tear items: tyres, chains, brake pads, bearings (except motor), grips, spokes, plastics, etc. 3.5.2. Cosmetic or superficial damage. 3.5.3. Water, chemical, or environmental damage. 3.5.4. Damage due to misuse, neglect, or unauthorised modification or repair. 3.5.5. Labour, transport, or downtime costs. 3.5.6. Routine maintenance or user-incurred penalties. 3.6. Claims must be made within 12 months of delivery. If delay is caused by Moto NZ or the manufacturer, the warranty period may be extended accordingly. 3.7. No refunds or exchanges are available unless a manufacturing defect is confirmed. Moto NZ may assist in arranging replacements where appropriate.

4. Title and Risk

4.1. Legal title to the Goods shall not pass until full payment has been received by Moto NZ. 4.2. Risk in the Goods shall pass to the Purchaser upon delivery to the address specified.

5. Trade Ins

5.1. Moto NZ does not accept trade-ins under any circumstances.

6. Cancellations, Returns, and Refunds

6.1. All purchases are deemed final and binding upon order confirmation. 6.2. No cancellations, returns, or refunds shall be accepted under any circumstances, including but not limited to: Change of mind, Delays in delivery, Dissatisfaction with specifications or performance, Inability to register, use, or insure the product, Warranty or service-related matters 6.3. In the event of incorrect Goods being supplied, or verifiable manufacturer defects, Moto NZ will assist in coordinating a resolution with the manufacturer, limited to the supply of correct or replacement parts. 6.4. Under no circumstance shall Moto NZ be obligated to provide a refund.

7. After-Sales Support

7.1. Moto NZ does not provide maintenance, repair, or servicing of Goods. 7.2. Upon request, Moto NZ may assist in sourcing compatible or original parts from the manufacturer or supplier.

8. Product Use and Compliance

8.1. Purchasers and users of the Goods must wear appropriate safety equipment during operation. 8.2. All vehicles are sold for off-road or private property use only, unless otherwise specified in writing. 8.3. Compliance with local laws, including registration, licensing, and usage restrictions, remains the sole responsibility of the Purchaser.

9. Limitation of Liability

9.1. To the fullest extent permitted by law, Moto NZ excludes all liability for: Personal injury, death, or property damage arising from use or misuse of the Goods, Losses due to delay, non-performance, or third-party shipping failures, Indirect, special, or consequential loss or damage 9.2. The total liability of Moto NZ under this agreement, whether in contract, tort, or otherwise, shall be limited to the value of the Goods purchased.

10. Privacy and Communications

10.1. Personal information provided by the Purchaser will be used solely for the purpose of fulfilling the sale, providing support, and issuing relevant communications from Moto NZ. 10.2. Customers may request access to or correction of their personal data at any time. 10.3. By entering into this agreement, the Purchaser consents to receive post-sale communication for feedback, parts support, and promotional purposes.

11. Promotional Content

11.1. With prior consent, Moto NZ may use customer-supplied images, testimonials, or reviews in advertising or promotional materials.

12. Governing Law and Dispute Resolution

12.1. This agreement shall be governed by and construed in accordance with the laws of New Zealand. 12.2. Any disputes arising from this agreement may be referred to the Motor Vehicle Disputes Tribunal or other forum as appropriate under New Zealand law.
